    May Forecast – Expect consistent surf from the South and Southwest. The rainy season hasn’t quite kicked in yet, so that means more offshore winds in the morning and a cooling rain shower most afternoons. It is past prime tourist time so the breaks will not be crowded. The best days of the month look to be from the 21st to the 23rd.

    Contests – The next contest on the CNS Tour will be the Torneo Britt Iced Tea in Nosara on May 22nd and 23rd.

    Five favorite surf spots within a one hour drive from Dominical:

    Quepos Rivermouth – although the wave was shortened by the extension of the marina, this fast left can still break over 200 meters at lower tides. It’s hardly ever is crowded due to the fact is it hard to see how good it’s breaking from the road.

    Playitas – At the far north end of the beach in Manuel Antonio, the wedging beach break is best at high tide. It is generally crowded by very talented local surfers because it is more consistent than nearby beaches, and can throw a nice barrel if there’s some size.Sean McGraw from Coldwell Banker, surfing in Dominicalito (2002)

    Dominicalito – The small village south of Dominical hides a few fantastic point breaks, rights and lefts. It only breaks on lower tides during big swells with the right angle, so only a select few know when it’s working, and also know how to

    avoid the dreaded rip currents.

    Playa Hermosa (north of Uvita) – If it’s too crowded near high tide in Dominical, this beach has the same wave quality but usually is empty. The point at the north end can produce nice rights and lefts at the right tide, but the window for

    catching it good (not closing out) is tiny.

    Playa Ventanas – This small pristine cove might not have the biggest surf, but it sure is a beautiful spot to be out in the

    lineup and look back on the mountains and jungle. And where else has two caves you can walk through from the beach to the ocean at low tide?

    Leading Costa Rica Parties Forge Political Agreement

    Incoming legislators of two of the country’s leading political parties are not letting their policy plans get strangled by opposition.
    Even before their official swearing-in ceremony, congress members from the National Liberation Party and the Libertarian Movement have signed a nine-page agreement, promising action on a slew of initiatives, from breaking Riteve’s monopoly on motor vehicle inspection to regulating online gambling.

    “Our obligation during the campaign was to emphasize our differences,” said President-elect Laura Chinchilla during the signing of the agreement. “But when the elections passed, the priority was to emphasize our (areas of agreement).”
    The two parties form a powerful force in the legislative assembly. Their combined total of 33 legislators is enough for the simple majority needed to push important projects through. However, they are slightly short of the 38 votes required to pass some bills.
    The two parties have given themselves two years to fulfill the agreement’s goals, promising to meet monthly in order to discuss progress.

    The agreement addresses a host of issues, including fighting crime by strengthening municipal police, increasing punishments for small crimes, and adding a chapter to the penal code regarding organized crime. It calls for greater international integration within the framework of the recently signed free trade agreements with China and Singapore, and seeks to improve border processes and to increase trade in the Central American region. The agreement also encourages the executive branch to take on certain initiatives such as increasing student access to computers, publishing a list of social aid recipients, and improving transparency.
    Former presidential candidate Otto Guevara said, “I don’t see any reason that this agreement shouldn’t go into effect in its entirety.”
    The Citizen Action Party, which lost six seats in the assembly this year, was invited to participate, but declined.

    Immigration Status to be Verifiable at Click of a Button

    Businesses will soon be able to pay to learn the immigration status of people residing in Costa Rica, according to a press release from Racsa, the state-owned Internet provider.

    After signing a contract with Racsa, for a fee of 100 colones per transaction, businesses will be able to check people’s immigration status based on first name, last name, birth date, nationality or cédula number.
    “This new official consultation system allows distinct public entities and businesses, principally in the financial sector, to validate the information of their clients with the official information registered with the Immigration Administration,” the statement read.
    Alberto Bermúdez, general manager of Racsa, said the new system, called Racsa-Interdata, will “give security to the work of many organizations in the country.”

    Immigration director Mario Zamora said the system addresses the need of many state and private institutions to know whether foreigners are residing legally in Costa Rica.

    Sixteen Rural Costa Rican Communities to Receive New Aqueducts

    The National Water and Sewer Institute (AyA) signed an agreement Thursday with the Agricultural Development Institute (IDA) to build aqueducts in 16 rural communities.
    The project requires an investment of ¢ 1.5 billion (nearly $3 million), half of which will financed by the Spanish government. The remaining 50 percent of the funds will come from the coffers of AyA and IDA.

    The communities were selected by AyA as areas where the demand for water has “grown substantially and (communities) require this service.”

    The water will supply 816 families – 4,100 people in all – with access to clean drinking water.
    “With the construction of these aqueducts we are improving the living conditions of 16 communities, while guaranteeing the sustainability of the infrastructure (being built),” said Ricardo Sancho, Executive President of AyA.
    The construction of the aqueducts will be supervised by a commission of engineers and builders from both IDA and AyA.

    The communities that will receive new aqueducts are:
    Playones de Cutris, La Virgen, San Jerónimo I, San Jerónimo II and La Palmera, in the North Huetar Region, southwest of San José; Junquillal, Montelimar, Llanos del Cortés, Lajas and Valle Real on the Nicoya Peninsula in the northwestern province of Guanacaste; La Cháves and Pablo Presbere in Heredia, north of San José; Libertad 2000 in southern Costa Rica’s Brunca region; Romakri and Pitahaya in the southern Pacific; and Cañuela in the central Pacific.

    Immigration putting expat residency data online

    The immigration agency is putting on line the personal information of legal foreign residents in the country. The agency has contracted with Radiográfica Costarricense S.A. to offer a service to firms and individuals who want to check out the status of foreigners.

    The Banco Nacional has been using the system in its banking activities in a pilot program. Those who seek to use the system have to sign up with Radiográfica Costarricense, known as RACSA. The charge is 100 colons per inquiry, about 20 U.S. cents.

    The immigration status of foreigners has been available on a case-by-case basis, but four years ago the Dirección General de Migración y Extranjería restricted that information to lawyers.

    The data base is set up to be searched by name, number of cédula, birth date, nationality and gender, said the immigration agency.

    Alicia Avendaño, director of the División de Gobierno Digital, said that the project is part of the process of providing transparency in government operations.

    A number of companies have asked for a system to check up on the legal status of foreigners in Costa Rica, said Mario Zamora, immigration director.

    Only foreigners who are permanent residents are allowed to hold jobs in Costa Rica, but there are many types of residency, including pensionado and rentista. Permanent residency usually is achieved after several years in one of the other categories.

    The system also will allow banks and potential employers to check the validity of cédulas presented by individuals and visas, which sometimes are forged.

    Expat challenges rule to renounce U.S. citizenship

    According to Costa Rican law, foreigners who seek Costa Rican nationality through length of residency have to agree to renounce their current citizenship.

    That is not the case for a person who obtains Costa Rican residency through a relationship with a Costa Rican.

    The issue is important for U.S. expats. While that country allows their citizens to hold other nationalities, most would not want to surrender their citizenship when they opt to become Costa Ricans.

    Now a Playas del Coco woman, identified by the Poder Judicial as Leslie Barbara Zelinski Levy, has filed a Sala IV constitutional case challenging the section of the immigration law that mandates surrendering a previous citizenship. She is a U.S. citizen.

    The case was filed by San José lawyer Bárbara Jiménez Coble. The appeal challenges the different ways Costa Rica handles the citizenship application in which one class of persons must surrender a foreign citizenship but another class, those obtaining citizenship through a family relationship, do not.

    A U.S. Embassy official told a writer Wednesday that a number of American citizens here have signed documents promising to renounce their citizenship, but that the embassy does not take the paperwork seriously.

    In a more formal account, the U.S. State Department says on its Web site “a person who acquires a foreign citizenship by applying for it may lose U.S. citizenship. In order to lose U.S. citizenship, the law requires that the person must apply for the foreign citizenship voluntarily, by free choice, and with the intention to give up U.S. citizenship.”

    Surrendering U.S. citizenship can be a formal process that some expats do in order to avoid U.S. taxes or for political reasons.

    In some cases because a treaty agreement exists between Costa Rica and another nation, citizens may assume dual nationality without the need to renounce the current one. The United States does not have such a treaty. That figures in the court appeal, too.

    Those who seek Costa Rican citizenship must show that they have been in the country a prescribed period, which varies based on their country of origin.

    Non-native Spanish speakers have to take a language test. All have to take a test over Costa Rican civics.

    Those who seek residency by a family relationship, such as a spouse or a child born here, do not have to take these tests.

    Some criminal suspects who are fleeing U.S. justice sometimes manage to obtain Costa Rican citizenship because the country’s Constitution prohibits the extradition of citizens. The citizenship process can be reversed if the Costa Rican government believes that there were misrepresentations in the naturalization process.
